Conditions of use

  1. Thank you for using our products and services. Please read and accept our Terms of Use. By accessing our website and purchasing or using our products and services you acknowledge that you have read and accept these ‘Terms of Use’ in full. The websites www.boatsecurity.com, www.localizatubarco.com and others through which our products and services are offered, are the property of BOAT SECURITY SEGURIDAD NAUTICA SL / CIF B72543325) hereinafter Boat Security.
  2. All of the software and platforms offered to you to access the information collected by our monitoring elements are also owned by Boat Security, and are protected by patent and trademark laws and may not be used in any way not expressly authorised by Boat Security.
  3. Access to and use of such information may not be resold or subleased without the express permission of Boat Security.

Acceptance of the TOU (Terms of Use)

  1. You access these services through your User Account login. By doing so, you acknowledge that you are aware of and agree to these Terms of Use, on behalf of yourself or an Organisation or company. In this case you declare that you are authorised and entitled to do so.

Limitation of liability

  1. Boat Security and/or its authorised partners are not responsible for any modification, loss or damage to any software, data or information stored by Boat Security.
  2. The systems and services offered by Boat Security are offered ‘as is’ and it is not responsible for the correct installation or the use that the user makes of them, not being systems intended for the protection of goods or persons, nor suitable as an aid to navigation.
  3. Boat Security makes no guarantee and has no liability whatsoever for:
    • GPS or GSM Reception Deficiency.
    • Loss of connectivity during use of the Service.
    • Loss of stored data and alerts on values received.
    • Inaccurate information, analysis or other metrics.
    • Anomalies in access to the service.
    • We shall not be liable for any loss of profit or business, corruption of data, direct or indirect economic loss, and damage to property and persons.
    • We cannot assure you that the availability of Access to information will be uninterrupted, or that it will be error-free.
    • Nor can we assure that the Software will be compatible with any present or future device.
  4. The systems marketed by Boat Security are monitoring and management support services, they cannot be considered alarm and anti-theft systems. For this reason Boat Security cannot be held responsible for possible damage to one’s own or other people’s property, theft, burglary or attempted criminal activity on boats equipped with our systems. Its tracking and tracing functions cannot be considered as a tracker but as a management aid.

Communications Systems

  1. Equipment communications and alerts are dependent on non-Boat Security communications providers and we are not responsible for their full availability.
  2. In no event shall we be liable for any direct or indirect, special, incidental or consequential damages (including, without limitation, loss of data and other information), damages for loss of business interruption, personal injury, loss of privacy arising out of or in any way connected with the use of or inability to use the services provided by Boat Security.

Duration of the agreement

  1. These Terms of Use are effective until terminated by Boat Security or You. You may do so at any time by notifying us that you no longer wish to use our services
  2. The obligations and liabilities of the parties incurred prior to the date of termination shall survive the termination of this agreement for all purposes.
  3. All information collected by Boat Security’s systems belongs exclusively to Boat Security. You, as a user, have access to this information, with the duration of the history to be defined at any given time. If, in Boat Security’s sole judgment, you fail to comply with any term or provision of these Terms of Use or fail to pay for the Services, Boat Security may also terminate this Agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or, accordingly, may deny you access to the Services (or any part thereof).
  4. Upon termination of the business relationship between Boat Security and the Customer, all data collected by the systems attached to that User Account will be deleted.

Licensing and intellectual property

  1. You agree that Boat Security owns all right, title and interest in and to all intellectual property and other proprietary rights in all trademarks and product names related to the Services offered by Boat Security (including, without limitation, trademarks, images, pricing, web content and data).
  2. Boat Security grants you an Access Licence to access and make personal, non-commercial use of the Services and data.
  3. This license does not permit the resale or commercial use of any Services or information collected by Boat Security Services. The processing of this information and its use by robots, data mining, etc. is not permitted. All rights to images, names, products and services not expressly granted are not permitted.

Applicable law in this agreement

  1. These Terms of Use are governed by Spanish law. For all doubts and conflicts that may arise from the interpretation and application of this contract that oblige both Boat Security and the User, the Courts and Tribunals of Bilbao shall have jurisdiction, expressly waiving any other forum that may correspond to them, however privileged it may be.

Changes to the terms of use

  1. Boat Security reserves the right to modify these terms of use at any time.
